MyGerber Program Terms
Welcome to the MyGerber Program (the “Program”) offered by the Gerber Products Company/Nestlé Infant Nutrition (“Gerber”). We’re glad you’re here, and we hope you enjoy everything we have to offer. By participating in the Program, you agree to these Terms, our Privacy Policy, and our website Terms & Conditions. Please read them carefully.
1. Who is Eligible
The Program is open to individuals who are residents of the United States and are at least thirteen (13) years old. Businesses or other groups of individuals are not eligible to participate in the Program. We reserve the right to request proof of eligibility at any time.
2. How to Register
To register, visit, complete the registration form, and create a Program account (your “Account”). You are responsible for maintaining the security of your Account, and you are responsible for all activities that occur under your Account. If you believe your Account has been compromised at any time, you must notify us immediately by sending an e-mail to our Contact Us Page.
3. Benefits
As a Program member, you are currently able to receive the benefits described below. Please note that we reserve the right to add, take away, or modify benefits at any time.
a. Coupon
After every fourth purchase of $50 or more – after coupons and before taxes and excluding gift cards – on Gerber.com, you will receive a coupon via e-mail for $10 off your next purchase of $50 or more – after coupons and before taxes and excluding gift cards – on Gerber.com. Your coupon can also be found in the My Offers page of your Account. The coupon will expire 30 days after it is issued.
b. Free Gift
When you spend $150 in a single purchase on Gerber.com more – after coupons and before taxes and excluding gift cards – you will have the opportunity to choose from a selection of free gifts.
c. Refer a Friend
You can use the features in the “Refer a Friend” section of the My Offers page of your Account to refer friends to join the Program. If your friend meets the eligibility requirements set forth above and joins the Program with your unique code, both you and your friend will each receive a coupon worth 10% off of a qualifying purchase of $50 or more – after coupons and before taxes and excluding gift cards – on Gerber.com. The coupon will expire 60 days after it is issued. Please note that you will not receive a coupon if your friend does not meet the eligibility requirements, is already a Program member, or does not use your unique code to join the Program.
4. Modifications and Termination
We reserve the right to modify any of the terms and conditions governing the Program at any time, with or without notice, even though these changes may affect your ability to receive benefits. Unless we tell you otherwise, modifications are effective immediately upon posting of the updated Terms. We also reserve the right to suspend or terminate the Program (in part or in its entirety) at any time, for any reason. If we do terminate the Program, we will notify you by e-mail.
Your continued participation in the Program constitutes your acceptance of any changes we make to these Terms. You are responsible for remaining knowledgeable about any changes we may make to these Terms. The most current version of the Terms will be available on insert URL and will supersede all previous versions of the Terms.
If you don’t agree to any change we make, you can stop participating in the Program. Let us know, and we’ll cancel your account.
5. General Terms
If we suspect that you have failed to comply with these Terms, no longer meet the eligibility requirements, engaged in fraudulent or inappropriate activity, or otherwise attempted to manipulate or unfairly benefit from the Program, as we determine, in our sole discretion, we reserve the right to terminate your Program membership, prohibit you from participating in the Program, and take appropriate legal action. If we terminate your Program membership, you will not be able to use any of the benefits you have accumulated.
Except where prohibited, you agree that any and all disputes, claims, and causes of action arising out of, or connected with, the Program shall be resolved individually, without resort to any form of class action, and exclusively by the appropriate court located in Virginia. All issues and questions concerning the construction, validity, interpretation, and enforceability of these Terms, your rights and obligations, or our rights and obligations in connection with the Program, shall be governed by, and construed in accordance with, the laws of Virginia, without giving effect to any choice of law or conflict of law rules (whether of Virginia or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than Virginia
By participating in the Program, you agree to release and hold Gerber, its parent, subsidiary and affiliate entities, and their respective officers, directors, employees, and agents harmless from and against any claim or cause of action arising out of participation in the Program, including, but not limited to any technical errors that may prevent you from using discounts.
If we need to communicate with you about the Program, we’ll send a message to the e-mail address associated with your Program membership. If your e-mail address changes after you register for the Program, you are responsible for promptly updating your Account.

Submissions to the Site

Any such use or activity is without compensation to and without further approval from, the person submitting. If Gerber accepts your submission and specifically agrees to keep it confidential or not use it, nevertheless, Gerber does not waive any rights it may have to similar or related ideas previously known to Gerber or developed by its employees, or obtained from sources other than you. All Content that you submit may be used at Gerber’s sole discretion and Gerber is under no obligation to use or post any Submission.
Submission Guidelines
By making a Submission, you represent that the Submission complies with these Terms and specifically the following Submission Guidelines:
- you are the sole author and either own all of the intellectual property rights to the Submission or have permission from the owner of any intellectual property rights in the Submission to make it available to Gerber;
- you are at least 18 years old;
- the Submission is not false, inaccurate or misleading; the Submission does not contain information or links that reference other websites, addresses, email addresses, contact information or phone numbers, or contain any person’s personally identifiable information;
- the Submission is not unlawful, defamatory, libelous, hateful, biased or offensive, indecent, pornographic, violent, threatening or harassing to any individual, or company, and does not encourage activity that is unlawful or that may create risks of legal liability or harm to others
- the Submission does not contain any computer viruses, worms or other potentially damaging computer programs or files.
- for product reviews:
- you did not receive any compensation or consideration or other benefit from anyone in connection with your review; and
- the review is focused solely on the product you are reviewing, and is based on your actual experience and knowledge.
Gerber may fully cooperate with any law enforcement authorities or court order requesting or directing Gerber to disclose the identity of anyone posting any Submission.
You agree to indemnify and hold Gerber (and its officers, directors, agents, subsidiaries, joint ventures, employees and third-party service providers), harmless from all claims, demands, and damages (actual and consequential) of every kind and nature, known and unknown including reasonable attorneys’ fees, arising out of a breach of your representations set forth above, or your violation of any law or the rights of a third party.
Right to Monitor or Remove Content
Gerber reserves the right to change, condense, remove or delete (or refuse to post) any Submission at any time, including if Gerber deems, in its discretion, that the content violates these Terms of Use. Gerber does not guarantee that you will have any ability through Gerber to edit or delete any content you have submitted. You acknowledge that Gerber is not responsible for your Submission or Submissions posted by any third parties. Your Submission is not subject to any obligation of confidence on the part of Gerber, its agents, subsidiaries, affiliates, partners or third party service providers, or any of their respective directors, officers and employees.
Copyright Complaints (DMCA policy)
Gerber respects the intellectual property of others, and we ask our users to do the same. Gerber may, in appropriate circumstances and at its discretion, suspend or terminate the access of and take other action against users, subscribers, registrants and account holders who infringe the copyright rights of others.
